3. How the rule works
Who this is for
Tenants whose landlord or property manager has entered without notice, or comes in more often than seems necessary, and who want to put a clear written request on record.
The letter is meant for ordinary disputes about entry. If you feel unsafe or the entries are part of an effort to force you out, contact local tenant services or the police as well.
What to have ready
- A log of each entry: date, time, who entered and what notice was given.
- Any notes, texts or emails the landlord sent about entering.
- Doorbell or camera footage, if you have it.
- The entry clause in your lease.
The rule
California Civil Code § 1954 lists the reasons a landlord may enter a rental: an emergency, necessary or agreed repairs or services, showing the unit to prospective tenants, buyers or contractors, a court order, the pre-move-out inspection, when the tenant has abandoned the unit, and a few others. Except in emergencies, the landlord must give reasonable written notice, and 24 hours is presumed reasonable (six days if the notice is mailed). Entry should be during normal business hours. Civil Code § 1940.2 prohibits using entry to harass a tenant and allows a penalty of up to $2,000 per violation.
Washington's RCW 59.18.150 requires at least two days' written notice before entry and one day before showing the unit. England's law differs: Landlord and Tenant Act 1985 s. 11(6) gives an implied right to enter for repairs on 24 hours' written notice, and harassment of a residential occupier is an offence under the Protection from Eviction Act 1977. New York has no single statewide entry-notice statute; leases and court decisions generally require reasonable notice.

Worked example: is this entry lawful?
A San Francisco manager leaves a note at 6 p.m. on Tuesday saying they will 'check the unit' at 9 a.m. Wednesday, and enters while the tenant is out.
Notice given : 15 hours, less than the 24 hours presumed reasonable
Reason stated : general check, not one of the § 1954 purposes
Emergency? : no
Result : likely not a permitted entry
Letter asks for : 24 hours' written notice, a stated lawful purpose,
and entry during normal business hoursCommon mistakes
- Refusing all entry. A landlord with proper notice and a lawful reason, such as a needed repair, is entitled to come in.
- Not keeping a log. Dates, times, notice given and the reason stated are what make a pattern visible.
- Changing the locks without permission, which can breach the lease.
- Claiming the $2,000 penalty for a single late notice. Section 1940.2 targets entry used to harass or intimidate.
Limits of this tool
- Entry rules vary by state and country, and some leases add longer notice periods.
- The letter generator does not assess whether the conduct is harassment; that depends on the full pattern.
- Emergency entry without notice is generally lawful everywhere.

4. Clear Next Steps & Statutory Action Plan
- Keep a written log of each entry with dates, notice given and any reason stated.
- Send a calm written request to follow the statute's notice and purpose rules.
- If entries continue, ask a local tenant organisation or legal aid about further steps.
5. Frequently Asked Statutory Questions (Cal. Civ. Code § 1954; N.Y. Real Prop. Law; UK Protection from Eviction Act 1977)
Can a California landlord enter for a routine inspection?
Section 1954 does not list general inspections as a reason. Entry for necessary or agreed repairs, showings and the move-out inspection is allowed with proper notice, and the lease cannot expand those reasons.
Does an emergency need notice?
No. A real emergency such as a burst pipe, fire or gas leak allows immediate entry everywhere.
How much notice is required in Washington?
At least two days' written notice to enter, and one day to show the unit to prospective tenants or buyers, under RCW 59.18.150.
