3. How the rule works

Who this is for

Gym and fitness club members who want to cancel, especially after moving, becoming disabled, or signing a contract the club will not let them leave, in California, New York or the UK.

Your contract may give more rights than the statute; read it first.

What to have ready

  • Your membership contract and member number.
  • How and when you signed up (online or in person).
  • Proof of your new address or a doctor's note, if relevant.
  • Your last few bank or card statements showing the charges.

The rule

California's Contracts for Health Studio Services law (Civil Code §§ 1812.80–1812.98) limits contract terms to three years, gives a right to cancel within five days of signing, and under § 1812.89 lets a member cancel and get a pro-rata refund if they die, become disabled so they cannot use the club, or move more than 25 miles from any of the club's facilities. Contracts entered into online must also allow cancellation online. New York General Business Law § 624 gives a three-business-day cooling-off period and a right to cancel for disability or relocation more than 25 miles away, with a pro-rata refund.

The FTC's 2024 'click-to-cancel' rule was vacated in July 2025, so state law, the federal ROSCA for online subscriptions and the contract itself govern. In the UK, the Consumer Rights Act 2015 makes unfair contract terms unenforceable, and the Competition and Markets Authority has taken action against gym terms that trapped members in long contracts.

Read the official text:

Worked example: moving 40 miles after paying for a year

A member prepaid $600 for 12 months, used 4 months, and moved 40 miles away, beyond 25 miles from every branch.

Unused months = 12 - 4 = 8
Pro-rata refund = $600 x 8 / 12 = $400
Proof to attach = new lease or utility bill showing the address
Also do = revoke card or ACH authorisation in writing

Common mistakes

  • Telling the front desk only. Send written notice and keep proof.
  • Not including evidence of the move or disability when the statute requires it.
  • Assuming cancellation stops the bank debits. Revoke the payment authorisation too.
  • Relying on the FTC click-to-cancel rule, which is not in force.

Limits of this tool

  • Gym cancellation rules vary by state; many states have health club statutes with different notice and refund rules.
  • Some fees, such as initiation fees, may be treated differently.
  • The letter cannot override a contract that gives you fewer rights than a statute requires; it asks the club to follow the law.

4. Clear Next Steps & Statutory Action Plan

  1. Find your contract and the cancellation clause.
  2. Send the cancellation letter by a method with proof of delivery, with any required documents.
  3. Revoke the payment authorisation and check your statements for later charges.

5. Frequently Asked Statutory Questions (Cal. Civ. Code § 1812.80–1812.98 (Health Studio Act); N.Y. Gen. Bus. Law § 624; FTC Click-to-Cancel Rule)

Can a California gym make me cancel in person if I joined online?

California requires health studio contracts entered into online to allow cancellation online, and the Automatic Renewal Law also requires online cancellation for online sign-ups.

What if I move away?

California and New York allow cancellation with a pro-rata refund if you move more than 25 miles from the club and its affiliates.

Is the FTC click-to-cancel rule in force?

No. A federal appeals court vacated it in July 2025.

How long can a California gym contract last?

Civil Code § 1812.84 limits health studio contracts to three years, and contracts must allow the member to cancel within five days of signing for a refund.

What should I do if the gym keeps charging after I cancel?

Send a copy of your cancellation and proof of delivery to the gym, revoke the payment authorisation in writing, and dispute later charges with your bank or card issuer. Keep the dates of each charge after cancellation.

Can the gym charge a cancellation fee?

It depends on the contract and the state. Statutory cancellation rights, such as for moving or disability, generally require a pro-rata refund and limit what the club can keep.
